Lawn Care Journal LLC (“Company,” “we,” “us,” or “our”), an Arizona limited liability company, operates the AZ HomeShield mobile application and related public website at azhomeshield.com (the “Website,” together with the App, the “Service”). The “App” means the AZ HomeShield mobile application for iOS. By downloading, installing, or using the App or accessing the Website (including the landing, terms, and privacy pages), you agree to these Terms of Service (“Terms”). If you do not agree, do not use the Service.

1. ELIGIBILITY AND ACCEPTANCE

You must be at least 13 years of age to use the Service. If you are under 18, you represent that you have your parent’s or guardian’s permission to use the Service. By using the Service, you represent that you meet these requirements.

Intended users. AZ HomeShield is designed for homeowners documenting defects and builder communication in connection with new-build homes in Arizona, including evidence that may be relevant to a complaint with the Arizona Registrar of Contractors (ROC). Features, references, and export formats in version 1 focus on Arizona ROC workflows. We may expand to other jurisdictions in the future; availability of jurisdiction-specific content is not guaranteed.

Worldwide distribution; Arizona focus. The App may be distributed through the Apple App Store in regions where we choose to make it available. You are responsible for ensuring your use of the Service complies with all laws in your jurisdiction. We make no representation that the Service is appropriate or available for use outside the United States. Access from prohibited jurisdictions is unauthorized. You may not use the Service if you are located in, or a resident of, any country subject to U.S. embargo or designated by the U.S. government as a “terrorist supporting” country (including those on OFAC sanctions lists). We reserve the right to block access from any jurisdiction.

App store terms. If you obtain the App through the Apple App Store, you are also subject to Apple’s applicable terms. Where those terms conflict with these Terms, the app store terms govern solely with respect to your relationship with Apple.

Website. Use of azhomeshield.com is subject to these Terms and our Privacy Policy.

2. LICENSE GRANT

2.1 Grant

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the App for your personal, non-commercial use in accordance with these Terms.

Apple App Store. If you obtained the App from the Apple App Store, Section 14 (Apple App Store — Licensed Application) sets forth additional required terms for that copy of the App (the Licensed Application), including the scope of your license together with this Section and the Apple Media Services Terms and Conditions.

2.2 Restrictions

You may not:

Copy, modify, or create derivative works of the App
Reverse engineer, decompile, or disassemble the App
Rent, lease, lend, sell, sublicense, or transfer the App or your rights under these Terms
Remove or alter any proprietary notices on the App
Use the App for any illegal purpose or in violation of any law
Use the App to harm, harass, or abuse others
Represent that AZ HomeShield is a licensed home inspection, legal, or ROC advocacy service

2.3 Ownership

We and our licensors retain all right, title, and interest in and to the App, including all intellectual property. These Terms do not grant you any ownership rights.

3.1 Accounts and authentication

The App requires Sign in with Apple, which creates a Firebase Authentication account. Your AZ HomeShield cloud identity is your Firebase user id (uid). You must use a compatible device running iOS 18 or later.

You are responsible for maintaining control of your Apple ID and device. We are not responsible for unauthorized access resulting from compromised credentials or unlocked devices.

3.2 Local storage and cloud sync

Your homes, rooms, issues, photos, builder communication logs, timelines, and related settings are stored locally on your device (Core Data). When you are signed in, the App may sync a cloud copy to Google Firebase (Firestore for structured records; Storage for photos) for backup and multi-device sync.

Free and Pro users who are signed in may sync cloud data, subject to product limits (for example, free-tier caps on creating new issues).
Cloud sync depends on network availability and Firebase service status.
You are responsible for reviewing synced data on each device you use.

We do not guarantee uninterrupted sync or that every edit will appear instantly on every device.

3.3 Cloud retention

Cloud copies may be deleted after 12 months of inactivity on a home, as described in our Privacy Policy. Local device data is not automatically deleted by that cloud retention policy. Uninstalling the App without deleting cloud data may leave a cloud copy until retention or account-deletion processes apply.

AZ HomeShield may allow you to share a home with another person (for example, a household member) using a QR code or invite deep link. When you share a home:

Only that home and its related data (rooms, issues, photos, and builder communication records tied to that home) are exposed to participants who accept the invite—not unrelated homes.
The participant must accept the invite while signed in with their own Apple ID / Firebase account.
Roles may include owner, editor, and viewer. Viewers receive read-only access; editors may change shared data when their subscription permits.
You are responsible for choosing whom you invite and for the accuracy and sensitivity of information you share.
You may revoke membership at any time through the App; revocation stops future access for that participant, subject to any copies they exported outside the App.
We are not responsible for how a shared participant uses, stores, or discloses information you share with them.

3.5 Deletion

To delete your data, use the in-app deletion controls as offered in the App. See our Privacy Policy for data portability and deletion rights. Signing out stops sync for that session on the device but may not delete cloud data.

4. ACCEPTABLE USE

You agree not to:

Violate any applicable law or regulation
Infringe the rights of others, including privacy or intellectual property rights
Upload content you do not have the right to share (including photos of others’ property or persons without appropriate permission)
Transmit malware, viruses, or harmful code
Attempt to gain unauthorized access to the App, the Website, our systems, Firebase, or other users’ data
Use the App or the Website to send spam or unsolicited communications
Interfere with or disrupt the App, the Website, or their infrastructure
Misrepresent AZ HomeShield output (including AI evaluation or exported packets) as official ROC, legal, or inspection findings
Use automated means (bots, scrapers) to access the App or Website without our permission
Share invite links publicly or with people who should not see your home data

We may suspend or terminate your access for violation of these Terms.

5. AI-GENERATED CONTENT

The App may offer AI evaluation (powered by Grok through a server-side AZ HomeShield proxy) when you request it and when your subscription tier includes the feature. Categories of information sent to the AI proxy are described in our Privacy Policy.

Educational only — not legal advice. AI-generated content is for informational and organizational purposes only. It is not legal advice, not home inspection advice, and not a guarantee that the ROC or any other authority will accept, approve, or act on a complaint. AI output may be incomplete, inaccurate, outdated, or inapplicable to your situation.

Your responsibility. You are solely responsible for reviewing, verifying, and deciding whether to rely on any AI-generated content before contacting your builder, an attorney, an inspector, or the ROC. We are not liable for any harm resulting from reliance on AI-generated content.

No API keys in the App. The App does not embed third-party AI provider API keys. AI requests are routed through our proxy under our control, subject to rate limits and prompt versioning described in our Privacy Policy.

Provider changes. The AI provider, models, prompts, and ROC reference materials used by the proxy may change at any time. We will use reasonable efforts to maintain quality but do not guarantee uninterrupted AI availability or specific evaluation results.

6. USER CONTENT

The App allows you to create and store homes, rooms, issues, photos, builder contact information, communication logs, timelines, notes, exported PDFs, and other materials you submit (“User Content”):

You retain ownership of your User Content
You grant us a non-exclusive, royalty-free license to use, store, process, and display your User Content only as necessary to provide and improve the Service (including Firebase sync, AI evaluation when you request it, PDF export, and household sharing you initiate)
You represent that you have the right to share your User Content and that it does not violate these Terms or any third-party rights
We may remove or restrict access to User Content that violates these Terms or that we deem inappropriate

6.1 Accuracy and completeness

You are solely responsible for the accuracy and completeness of information you enter, including dates, photos, builder contacts, and communication logs. AZ HomeShield does not verify your entries.

6.2 Exports and communications

When you email a builder, share a PDF, or otherwise transmit User Content outside the App, you choose the recipient and channel. Those transmissions are outside our control once they leave the App.

7. SUBSCRIPTIONS AND PAYMENTS

AZ HomeShield may offer free features and paid AZ HomeShield Pro subscriptions via Apple’s In-App Purchase system.

Payment is charged to your Apple ID account at confirmation of purchase.
Subscriptions auto-renew unless canceled at least 24 hours before the end of the current period.
Your account will be charged for renewal within 24 hours prior to the end of the current period.
Manage or cancel in Apple ID → Subscriptions (also linked from the App paywall and Support & Legal).
Free tiers may limit features such as the number of issues you can create, AI evaluation, ROC packet export, multi-issue builder follow-up, or sharing capabilities.
We may change prices or offerings; Apple’s store rules govern how price changes apply to existing subscribers.

Restore Purchases is available in the App for Apple-mediated entitlements. RevenueCat may be used to manage entitlement status keyed to your Firebase uid.

8. DISCLAIMERS

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

Without limiting the foregoing:

AZ HomeShield is not a law firm, licensed home inspector, or ROC advocate.
AZ HomeShield does not guarantee any builder response, warranty outcome, or ROC complaint result.
We do not submit ROC complaints on your behalf.
Educational content and AI output may be incomplete or incorrect.
We do not warrant uninterrupted availability of Firebase, Apple services, AI providers, or the App.

9. LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE AND OUR AFFILIATES, OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, PROFITS, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE.

OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF THESE TERMS OR THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID US FOR THE SERVICE IN THE TWELVE (12) MONTHS BEFORE THE CLAIM OR (B) ONE HUNDRED U.S. DOLLARS (USD $100).

No liability for third-party acts. We are not liable for the conduct of third parties, including your builder, other users, shared participants, app store operators, service providers, Apple, Google Firebase, RevenueCat, or AI infrastructure providers.

Some jurisdictions do not allow certain limitations; in those jurisdictions, our liability is limited to the fullest extent permitted by law.

10. INDEMNIFICATION

You agree to indemnify and hold harmless Lawn Care Journal LLC and its officers, employees, and agents from claims arising out of your User Content, your use of the Service, your household invites, or your violation of these Terms.

11. TERMINATION

We may suspend or terminate access to the Service if you violate these Terms or if we discontinue the Service. You may stop using the App at any time. Provisions that by their nature should survive (including ownership, disclaimers, limitations of liability, and dispute terms) will survive termination.

12. DISPUTE RESOLUTION; GOVERNING LAW

These Terms are governed by the laws of the State of Arizona, without regard to conflict-of-law principles. Except where prohibited, you agree that exclusive venue for disputes relating to these Terms or the Service will be state or federal courts located in Arizona, and you consent to personal jurisdiction there.

If a court of competent jurisdiction finds any provision unenforceable, the remaining provisions remain in effect.

13. CHANGES TO THESE TERMS

We may update these Terms from time to time. We will post the updated Terms on azhomeshield.comterms/ and/or provide in-app notice for material changes. Continued use after the effective date constitutes acceptance.

14. APPLE APP STORE — LICENSED APPLICATION

The following terms apply when you obtain the App from the Apple App Store (the “Licensed Application”):

14.1 These Terms are between you and Lawn Care Journal LLC only, not Apple. Apple is not responsible for the Licensed Application or its content.

14.2 The license granted is limited to a non-transferable license to use the Licensed Application on Apple-branded products that you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions.

14.3 Apple has no obligation to provide maintenance or support for the Licensed Application.

14.4 In the event of any failure of the Licensed Application to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price (if any). To the maximum extent permitted by law, Apple has no other warranty obligation with respect to the Licensed Application.

14.5 Apple is not responsible for addressing any claims by you or a third party relating to the Licensed Application or your possession and/or use of the Licensed Application, including product liability claims, claims that the Licensed Application fails to conform to legal or regulatory requirements, and claims arising under consumer protection or similar legislation.

14.6 In the event of any third-party claim that the Licensed Application or your possession and use of it infringes that third party’s intellectual property rights, Lawn Care Journal LLC, not Apple, will be solely responsible for the investigation, defense, settlement, and discharge of any such claim to the extent required by these Terms.

14.7 You represent and warrant that you are not located in a country subject to a U.S. Government embargo, or designated as a “terrorist supporting” country, and you are not listed on any U.S. Government list of prohibited or restricted parties.

14.8 You must comply with applicable third-party terms when using the Licensed Application (for example, wireless data service agreements).

14.9 Apple and Apple’s subsidiaries are third-party beneficiaries of these Terms as they relate to your license of the Licensed Application, and upon your acceptance, Apple will have the right to enforce these Terms against you as a third-party beneficiary.
